1. Definitions

  • “We”, “Our”, “Us” refers to Dale Print.

  • “You”, “Your” refers to the user, customer, or client accessing our website or purchasing our products and services.

  • “Services” refers to commercial printing, photocopying, graphic design, signage production, and related offerings provided by Dale Print.

2. Use of the Website

  • You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, this site by any third party.

  • Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offense.

3. Quotes, Pricing, and Orders

  • Quotations: All quotes provided are valid for 30 days unless otherwise specified. Prices are subject to change if project specifications or artwork requirements change.

  • Payment Terms: Payment is required prior to production commencement unless prior commercial credit arrangements have been explicitly agreed upon in writing by Dale Print.

  • Turnaround Times: Estimated production and turnaround times are given in good faith but do not constitute a formal guarantee. We are not liable for any losses incurred due to delivery or production delays beyond our reasonable control.

4. Customer Artwork and File Submissions

  • File Responsibility: While our team conducts preliminary checks on graphic files, you are ultimately responsible for ensuring that all files submitted (including text, spelling, layout, resolution, and color profiles) are correct and ready for print.

  • Copyright and Intellectual Property: By submitting artwork, logos, or designs to Dale Print, you warrant that you own all intellectual property rights to the material or have obtained all necessary permissions and licenses to use and reproduce it. You agree to indemnify Dale Print against any claims, costs, or damages arising out of any breach of intellectual property rights.

  • Unacceptable Content: We reserve the right to refuse to print any material that we deem, at our absolute discretion, to be illegal, defamatory, offensive, or in violation of copyright laws.

5. Proofing and Approvals

  • Once a digital or physical proof is supplied, you must review it thoroughly. Production will not proceed until final approval is granted. Dale Print is not responsible for errors (such as typographical errors, misspellings, or layout mistakes) present in proofs that have been approved by the customer.

6. Refunds, Returns, and Replacements

  • Because our products are custom-manufactured to your exact specifications, we do not offer refunds or exchanges for change of mind.

  • If a product contains a manufacturing defect or fails to match the approved proof or agreed-upon specifications, you must notify us within 7 days of receiving your order. We will review the issue and, at our discretion, reprint or rectify the defective items.

7. Limitation of Liability

To the maximum extent permitted by law (including the Australian Consumer Law), Dale Print’s liability for any loss or damage suffered in connection with our products or services is limited strictly to, at our option:

  • The replacement of the products or the supply of equivalent products;

  • The repair of the products; or

  • The payment of the cost of replacing the products or acquiring equivalent products. We shall not be liable for any indirect, incidental, or consequential losses, including loss of business profits or revenue.

8. Governing Law

These Terms of Use and any separate agreements whereby we provide services to you shall be governed by and construed in accordance with the laws of Western Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia to resolve any disputes.

9. Changes to Terms

We reserve the right to update, modify, or replace any part of these Terms of Use at our discretion by posting updates on our website. Your continued use of the website or our services following any changes constitutes acceptance of those changes.
